To Counsel of Record For All Parties Pursuant to the Attached Service List Re: Anthem/Blue Cross and Blue Shield of Maine Consolidated Docket No. INS 99-14 Ladies and Gentlemen: It has been brought to my attention that the Applicants believe it to be in the best interest of all to resolve immediately the issue of whether Anthem must comply with the filing and approval requirements of 24-A M.R.S.A. §§ 4203-4204 in order to acquire the HMOMaine line of business. I agree that this is a question that requires resolution as soon as practicable. By this letter, I am establishing November 23, 1999 as the deadline for any party who believes Anthem is required under the law to make the filings required by 24-A M.R.S.A. §§ 4203-4204 to file a written legal brief supporting its contention. The Applicants have until November 30, 1999 to reply to any briefs filed. I do not wish to have responses to the Applicants reply brief filed. Following a review of the written submissions, I may schedule a conference call to take additional argument or I may rule on the briefs. I am reserving the right to raise arguments in favor of compliance with the filing requirements should no party file a brief in which case the Applicants will have an opportunity to reply to any arguments raised.
