Pharmacist

Description

Pharmacist means an individual licensed by this State to engage in the practice of pharmacy.

A. "Chain pharmacist" means an individual who is practicing pharmacy within a chain; that is, where there is a corporate grouping of 4 or more stores. [1987, c. 710, §5 (new).]

B. "Hospital pharmacist" means an individual who is practicing pharmacy in a hospital setting. [1987, c. 710, §5 (new).]

C. "Independent pharmacist" means an individual who is practicing pharmacy in an independent pharmacy; that is, where there are fewer than 4 pharmacies under the same ownership. [1987, c. 710, §5 (new).]

D. "Qualified assistant pharmacist" means an individual licensed by this State as a qualified assistant apothecary, qualified assistant or assistant pharmacist, provided that the license is in full force and effect, except for the right to serve as a "pharmacist in charge."

THE FOLLOWING IS THE APPLICATION PROCEDURE:

  1. Complete the application for licensure by examination (check the appropriate box) as directed on the application.

  2. Complete the SBI criminal history record check form. Submit with application for examination along with a separate $8.00 fee payable to Treasurer State of Maine (must be in the form of a check or money order).

  3. Complete the NAPLEX registration form (included in the NAPLEX/MPJE Registration Bulletin) The fee for the NAPLEX is $250 (payment MUST be in the form of a certified bank check or money order payable to NABP). NABP will NOT accept a personal check.

  4. Complete the MPJE registration form (included in the NAPLEX/MPJE Registration Bulletin). The fee for the MPJE is $85 (payment must be made in the form of a certified bank check or money order payable to NABP). NABP will NOT accept a personal check.

    NOTE: Please be sure to read the NAPLEX/MPJE Registration Bulletin carefully. It contains very important information about these exams. All of the above items may be submitted at the same time. The payments, however, must be made separately.

  5. Upon receipt, the applications will be reviewed to determine your eligibility. Once your completed applications have been accepted, this office will submit the appropriate registration forms directly to NABP. You will then be notified, in writing, that your applications have been accepted and forwarded to NABP.

  6. NAPLEX and MPJE results are reported electronically to the Maine Board. The applicant will be notified, in writing, of a passing or failing score.

THE FOLLOWING IS THE APPLICATION PROCEDURE:

The fee for Maine Licensure is $150 (payment may be made in the form of a check or money order payable to Treasurer, State of Maine, VISA or MasterCard - see credit card authorization form).
  2. Complete the SBI criminal history record check form. Submit with application for licensure by score transfer along with a separate $8.00 fee payable to Treasurer State of Maine (must be in the form of a check or money order).
  3. Complete the Multistate Pharmacy Jurisprudence Examination registration form (included in the Registration Bulletin) and submit with your application for licensure. The fee for the MPJE is $85 (payment must be made in the form of a certified bank check or money order and made payable to NABP). NABP will NOT accept a personal check.
  4. Once the completed applications are received at the Board office, a letter of acknowledgment will be sent to you.
  5. Score Transfer reports and MPJE results will be reported electronically to the Maine Board. The applicant will then be notified of a passing or failing score. If the applicant passes, a license will be issued without delay. If the applicant fails, please contact the Board Clerk for information on retaking the exam.

LICENSURE BY RECIPROCITY - INSTRUCTIONS

Licensure by reciprocity cannot be acquired from California and Florida (see Maine Pharmacy Act, Section 13733(2).

The following is the application procedure:

  1. Complete the Preliminary Application for Transfer of Pharmaceutic Licensure form as directed on the application and submit to NABP. along with the required fee. The fee to NABP must be in the form of a certified check or money order payable to N.A.B.P. - PERSONAL CHECKS OR CREDITS CARDS WILL NOT BE ACCEPTED.
  2. NABP. Will return to you a completed application based on the information provided on the preliminary application. You will then submit the completed application to the Maine Board along with the $150 application fee. Payment may be in the form of cash, check or money order payable to Treasurer State of Maine, VISA, or MasterCard.
  3. Complete the Multistate Pharmacy Jurisprudence Examination (MPJE) registration form and submit it to the Board along with your licensure transfer application. The fee to sit for the MPJE is $85. Payment must be made in the form of a certified bank check or money order payable to NABP. PERSONAL CHECKS OR CREDIT CARDS WILL NOT BE ACCEPTED.
  4. Complete the SBI criminal history record check form. Submit with application for licensure by score transfer along with a separate $8.00 fee payable to Treasurer State of Maine (must be in the form of a check or money order).
  5. Once the completed applications are received at the Board office, a letter of acknowledgment will be sent to you. The Board office will then forward employment verifications to each of the employers listed on the application. These must be returned directly to the Maine Board by each employer (if all of the employers do not respond, the Board prefers to receive at least the two most recent).
  6. An applicant's file is complete when the Board office has received all of the required information (licensure transfer application, MPJE registration application, fees, verification of employment forms, and photo i.d). The MPJE registration application will be forwarded to NABP via Federal Express next day service. You will be contacted by NABP regarding a testing date.
  7. MPJE results will be reported electronically to the Maine Board. Upon passing the MPJE, the application file will be reviewed by the Board at their next available meeting. If the file is approved, a license will be issued without delay. If the applicant fails, opportunity will be given to re-take the exam by contacting the Board Clerk.

REQUIREMENTS
  • A late fee of $10.00 is assessed for licenses renewed after the license expiration date.
  • Licenses may be renewed up to 90 days after the date of expiration upon payment of a late fee of $10 in addition to the renewal fee. Inactive Pharmacist

Description

Inactive pharmacist means a pharmacist under the age of 65 who is not currently practicing pharmacy in the state of Maine. If an active pharmacist wants to change their license to inactive status, a request must be submitted, in writing, to the Board. During the time that a pharmacist is on inactive status, no continuing is required for renewal.

If a pharmacist wants to re-activate their license, a request must be submitted, in writing to the Board along with 15 hours of continuing action obtained during the previous calendar year.

Inactive Senior Pharmacist

Description

Inactive senior pharmacist means a pharmacist age 65 or over who is not currently practicing pharmacy in the state of Maine.

If an active pharmacist wants to change their license to inactive status, a request must be submitted, in writing, to the Board. During the time that a pharmacist is on inactive status, no continuing is required for renewal. If a pharmacist wants to reactivate their license, a request must be submitted, in writing to the Board along with 15 hours of continuing action obtained during the previous calendar year.

Pharmacy Technician

Description

Pharmacy technician means a person employed by a pharmacy who works in a supportive role to, and under the direct supervision of, a licensed pharmacist.

Qualified Assistant

Description

(The current law does not have a definition of qualified assistant) The following is the definition from a law established in 1981: Qualified assistant pharmacist as used herein shall be limited to any natural person duly licensed by the Board of Pharmacy as a qualified assistant apothecary or qualified assistant, or assistant pharmacist and shall be synonymous with same provided said license is in full force and effect.

Pharmacy

Description

Pharmacy means a retail drug outlet registered with the board.

REQUIREMENTS
  • Complete the application for registration of a drug outlet and submit along with the appropriate fee (check or money order payable to Treasurer State of Maine, VISA, or MasterCard).
  • Submit a scaled drawing of the drug outlet which details the usage of each area. If the registered area is part of a larger retail store, an additional scaled drawing of the entire establishment shall be furnished showing the relative position of the registered area and the location of all entrances, bathrooms, and storage area.

Mail Order Prescription Pharmacy

Description

A mail order prescription pharmacy is an entity that dispenses prescription medications by mail or carrier from a facility not located in the state of Maine to a patient who resides in Maine.

Mail Order Contact Lens Supplier

Description

Mail order contact lens supplier means a person or entity, other than an optometrist or physician licensed in this State, that fills contact lens prescriptions by mail or carrier for a patient who resides in this State.

Wholesale distributor means anyone engaged in wholesale distribution of prescription drugs, including, but not limited to, manufacturers; repackers; own-label distributors; private-label distributors; jobbers; brokers; warehouses, including manufacturers' and distributors' warehouses, chain drug warehouses and wholesale drug warehouses; independent wholesale drug traders; and retail pharmacies that conduct wholesale distributions.

  • Licenses may be renewed up to 90 days after the date of expiration upon payment of a late fee of $10 in addition to the renewal fee.
  • Any person who submits an application for renewal more than 90 days after license expiration date is subject to all requirements governing new applicants and is required to reapply with original license application, documentation and fees.
  • Renewal applications are mailed 60 days prior to the license expiration date. It is the licensee's responsibility to keep the Board informed of the current license address and/or to see that the license is renewed absent the renewal application.

Our Purpose

The Board of Pharmacy was established to protect the public through the regulation of pharmacies and pharmacists in Maine.

The primary responsibilities of the Board are to examine and license qualified applicants for licensure in the categories of Pharmacists or Pharmacists Assistants; to regulate and control the sale, character and standards of all drugs, poisons or medicines; to inspect during business hours all apothecaries, dispensaries, and locations where pharmaceuticals are manufactured, stored, distributed, compounded, dispersed or retailed; to secure samples of drugs and cause them to be analyzed and to keep a record of all persons examined and registered. The Board also investigates complaints against licensees and takes appropriate disciplinary action.
