Manufactured Housing Installer

Description

"Installer" means any person licensed by the Department of Professional and Financial Regulation engaged for compensation in the installation and service of the installation of manufactured housing.

"Installation" means the process of affixing or assembling or setting up manufactured housing on foundations or supports at a building site, and includes the connection to existing electrical, oil burner, gas, water, sewage and similar systems which are necessary for the use of the house for dwelling or commercial purposes.

REQUIREMENTS
  • Completed Notarized Application;
  • A State of Maine Sales Tax Number. To obtain a sales tax number, you may contact the Maine Revenue Services by writing to 24 State House Station, Augusta, ME 04333, or by telephone at (207) 287-2336;
  • A letter of good standing from the Secretary of State Corporation Division if the applicant is a corporation and if an out of state or foreign corporation, documentation of registration with the Maine Secretary of State Corporation Division. You may contact the Secretary of State Corporation Division by telephone at (207) 287-3676;
  • If the applicant is a foreign corporation, a duly-executed power of attorney appointing the Executive Director as its agent for service of process in this State;
  • Proof of products/completed operations liability insurance for at least $300,000.00 and, where required, proof of workers' compensation insurance. Liability policy must include mandatory notice of cancellation to the Manufactured Housing Board;
  • If the applicant is an individual, payment of a separate $8.00 fee for a criminal records (SBI) check. Make check payable to the Treasurer, State of Maine; and
  • Credit Card Application, if authorizing payment of license fee(s).

  • A late fee of $50.00 is assessed for licenses renewed after the June 30 license expiration date; and
  • Completion of criminal conviction question by indicating yes or no, and submission of documentation that lists date(s) and crime(s) and submit a copy of the court judgment(s). If your answer is "Yes" you cannot file your renewal application electronically. You must mail the completed renewal application and the necessary fees along with a copy of the court judgment. You must also submit a letter listing the date of the conviction, the crime committed, and explaining the circumstances surrounding the conviction;
  • A person who submits an application for renewal more than 90 days after the June 30 license expiration date is subject to all requirements governing new applicants and is required to reapply with original license application, documentation and fees.

Manufactured Housing Dealer

Description

Dealer means a person licensed by the Department of Professional and Financial Regulation engaged in the retail selling or offering for sale, brokering or distribution of manufactured homes, primarily to a person who, in good faith, purchases these homes for purposes other than resale.

  • A State of Maine Sales Tax Number. To obtain a sales tax number, you may contact the Maine Revenue Services by writing to 24 State House Station, Augusta, ME 04333, or by telephone at (207) 287-2336;

Manufactured Housing Mechanic

Description

Mechanic means a person licensed by the Department of Professional and Financial Regulation engaged in servicing or installing manufactured housing, as defined in section 9002, subsection 7, paragraphs A and C, for compensation and is not a regular employee of a manufacturer or a dealer.

  • If the applicant is an individual, payment of a separate $8.00 fee for a criminal records (SBI) check. Make check payable to Treasurer, State of Maine;
  • A completed Consent to Service of Process Form if the applicant is a non-resident of this State; and
  • Credit Card Application, if authorizing payment of license fee(s).

Manufactured Housing Manufacturer

Description

A manufacturer licensed by the Department of Professional and Financial Regulation engaged in manufacturing or producing manufactured housing and then selling it to a dealer.

  • Biennial - June 30 of even years
REQUIREMENTS
  • Completed Notarized Application;
  • A completed Consent to Service of Process Form if the applicant is a foreign corporation;
  • Proof of products/completed operations liability insurance for at least $1,000,000.00 and, where required, proof or workers' compensation insurance. Liability policy must include mandatory notice of cancellation to the Manufactured Housing Board;
  • For initial licensure as a manufacturer, the applicant shall submit their installation manual to be maintained on file at the Office. Subsequent change in the installation manual shall be submitted with the application for license renewal;
  • A letter of good standing from the Secretary of State Corporation Division if the applicant is a corporation. To obtain a letter of good standing, you may contact the Secretary of State Corporation Division by telephone at (207) 287-3676; and if the applicant is an out of state corporation, documentation if registration with the Maine Secretary of State Corporation Division;
  • A building system for evaluation in accordance with the requirements of Subpart D of the Rules for the State Certification of Manufactured Housing if the applicant is a manufacturer of modular housing;
  • Credit Card Application, if authorizing payment of license fee(s); and
  • If the applicant is an individual, payment of a separate $8.00 fee for a criminal records (SBI) check. Make check payable to Treasurer, State of Maine.

Mobile Home Park

Description

A mobile home park licensed by the Department of Professional and Financial Regulation that is a parcel or adjoining parcel of land, under single ownership, that has been planned and improved for the placement of 3 or more mobile homes, but does not include a construction camp.

  • Application of Intent $25.00
  • For New Ownership and New Parks:

Park with 3-100 approved sites $40.00 plus $4.00/per site

Park with 101 or more approved sites $440.00 plus $1.00/per site

  • For Park Expansion:

Park with 3-100 approved sites $4.00/per new site

Park with 101 or more approved sites $1.00/per new site

TERM
  • Annual - March 31
REQUIREMENTS
  • Application of Intent;
  • Application for a Mobile Home Park License;
  • Application of Intent fee and license fee;
  • A copy of the final plans signed by the town planning board or a statement from either the town manager or selectperson that town planning board approval is not required;
  • A copy of the deed and the location and legal description of the tract of land upon which it is proposed to operate and maintain a mobile home park;
  • A detailed site plan(s) of water and sewer lines, disposal systems, well and pump house location, mobile home pads and driveways shall be submitted on a scale of 1" equals 20';
  • A plan locating existing or propose facilities in the park for water supply, waste water disposal, electrical services and necessary buildings;
  • A statement from a key municipal official (town manger or select person) or from an attorney stating the park meets all the local requirements not preempted by Federal and State law;
  • Documentation that the Division of Health Engineering, Department of Human Services, has reviewed the plans and they meet all requirements of that Department relating to drinking water and wastewater disposal. If municipal services are used, a letter of documentation from the utility that will provide the service;
  • If Department of Environmental Protection (DEP) approval is needed, the document must include that approval. If DEP approval is not needed, then an affidavit by the park owner that have been submitted to DEP and a verbal order was stated that no approval was needed;
  • A statement from a Maine licensed electrician stating that the plan meet requirements of the current edition of the National Electrical Code (NEC)(NFPA 70) as adopted by the Electricians Examining Board;
  • A statement of the municipal fire chief that the plans meet the requirements of local and state fire codes; and
  • Credit Card Application, if authorizing payment of license fee(s).

Annual renewal fees are based on the number of sites in the mobile home park.

  • Parks that currently have 3-100 approved sites will be assessed $40 plus $4 per site.
  • Parks that currently have 101 or more approved sites will be assessed $440 plus $1 per site for each lot over 100.

  • If there is a transfer of ownership or any changes to the renewal, the changes must be made on a separate application, go to download application above.
  • Credit Card authorization of payment of renewal fee(s);
  • A late fee of $50.00 is assessed for licenses renewed after the March 31 license expiration date; and
  • A person, firm or corporation who submits an application for renewal more than 90 days after the March 31 license expiration date is subject to all requirements governing new applicants and is required to reapply with original license application, documentation and fees.

Our Purpose

The Manufactured Housing Board was established to ensure that manufactured housing is safe from hazardous defects, provide uniform performance standards for construction and installation of manufactured housing, and provide a safe and sanitary environment for occupants residing in mobile home parks.

The primary responsibilities of the board are to examine and license qualified applicants, to promulgate rules defining the qualifications and professional standards of manufacturers, dealers and installers of manufactured housing, to investigate complaints against its licensees, and to take appropriate disciplinary action against noncompliance with its statute and rules.
