Attendant

Description

"Attendant" shall mean any person who is employed part or full-time in funeral service who is engaged in transporting human remains and who may assist a Licensed Practitioner in other funeral activities. All Funeral Attendants shall work under the direct and personal supervision and legal responsibility of a licensed Practitioner who is actively associated with a funeral establishment. Each Practitioner employing a Funeral Attendant shall register the Funeral Attendant annually on forms supplied by the board and pay the prescribed fee. Each Funeral Attendant shall receive annual training in the review of the Blood-Borne Pathogen Rule. When a Funeral Attendant leaves the employ of a Practitioner, the Practitioner shall notify the board of termination of employment.

Practitioner Trainee

Description

A Practitioner Trainee means a person who is engaged in preparing to become licensed for the practice of funeral service under the personal supervision and instruction of a person duly licensed for the practice of funeral service, and who is duly registered as such and approved by the board.

Practitioner

Description

A Funeral Practitioner shall mean any licensed person engaged or holding themselves out as engaged in embalming and/or funeral directing, whether on their own behalf or in the employ of another, and shall include any person who shall use, in connection with their name, the words "embalmer," "funeral director," "mortician," or "undertaker" or any other words or title implying they are designating themselves to be an embalmer and/or funeral director.

  • Completed and signed application for licensure;
  • Copy of birth certificate (if not submitted previously);
  • Proof of completion of high school diploma or its equivalent (if not submitted previously);
  • Transcript(s) documenting completion of one (1) year of mortuary school and one (1) year of college or two (2) years of mortuary school;
  • Completed A, B, C cases;
  • Written proof of successful completion of the apprenticeship program;
  • Written proof of successful completion of the National Conference Examination;
  • Payment of the $75. examination fee.
  • Completed criminal history record check form and payment of a separate $8. fee for a criminal records (SBI) check.

Reciprocity

All applicants for a Practitioner license by reciprocity ("comity" / "endorsement") from another jurisdiction must submit the following:

  • Completed and signed application for licensure;
  • Copy of birth certificate;
  • Proof of completion of high school or its equivalent;
  • Written proof of successful completion of the National Conference Examination;
  • Completed Verification of Licensure from state(s) in which you hold or previously held licensure (Attachment B);
  • Transcript(s) documenting completion of one (1) year of mortuary school and one (1) year of college or two (2) years of mortuary school;
  • Written documentation that the applicant has been in active practice in another state for at least three years immediately preceding application in Maine. (As proof, the Board will accept letters from employers that the applicant is actually engaged in their employment.);
  • Payment of the $75. Examination fee; and
  • Completed criminal history record check form and payment of a separate $8. fee for a criminal records (SBI) check.

Inactive Status:
Practitioner or Director

Description

  1. An individual who is currently licensed as a Practitioner or Director may request that his/her license be place on inactive status.
  2. Each applicant must no longer be actively practicing funeral service in the State of Maine
  3. All inactive status licensees are required to renew their licenses annually but are not required to meet the continuing education requirement required by 32 MRSA, Chapter 21, Subchapter III, Section 1506(2) and the rules adopted under it.
  4. In order to reinstate a licensee's active license, the holder must comply with the continuing education requirement and fees as are provided in 32 MRSA, Chapter 21 and the rules adopted under it.

Funeral (Home) Establishment

Description

"Funeral Establishment" means every place or premise devoted to or used in the care and preparation for the funeral and burial of human remains or maintained for the convenience of the bereaved for viewing or other services in connection with the human remains or as the office or place for carrying on the profession of Funeral Service.

  • All funeral establishments and branches must be operated by a person or persons holding a funeral director's licenses, which was initially issued before January 1, 1989, or a practitioner of funeral service license.

Our Purpose

The State Board of Funeral Services was established to protect the public through the regulation of the practice of funeral services in the State of Maine.

The primary responsibilities of the Board is to examine and license qualified applicants for licensure to practice funeral service, to inspect funeral establishments and to revoke or to refuse to renew any licenses after proper notice and hearing.
