Aesthetician
means the performance by any person for hire or compensation of
any one or a combination of the following practices:
A. Beautifying,
massaging, cleansing, stimulating, toning, or exercising the
skin of the human body by the use of cosmetic preparations,
tonics, lotions, creams, antiseptics or clays or any device,
electrical or otherwise, for the care of the skin;
B. Applying
makeup or eyelashes to any person; or
C. Trimming
or tinting eyebrows and eyelashes.
The practice
of aesthetics under this subsection does not include the diagnosis,
treatment or therapy of any dermatological condition.

Barbering
means any one or any combination of the following practices, when
done for hire or compensation, upon the upper part of the human
body for cosmetic purposes and not for the treatment of disease
or physical or mental ailments:
A. Shaving
or trimming the beard, manicuring the fingernails, or cutting,
arranging, waving or styling the hair;
B. Giving
facial and scalp massage or treatments with cosmetic preparations,
either by hand or mechanical or electrical appliances;
C. Singeing,
dyeing, tinting, bleaching or shampooing the hair or applying
cosmetic preparations to the hair, scalp, face, neck or upper
part of the body;
D. Removing
superfluous hair from the face, neck or upper part of the body;
or
E. Cutting,
fitting, coloring or styling hairpieces or wigs.

Description
Instructor
means a person may not instruct in any of the branches of aesthetics,
barbering, cosmetology or manicuring unless that person holds
a valid license to practice and is authorized to instruct in each
respective practice issued under this chapter, except that when
specifically authorized by law, physicians may instruct without
holding a license to practice in a branch of aesthetics, barbering,
cosmetology or manicuring.

| REQUIREMENTS |
An exam is required to hold this license. You must comply
with the following in order to qualify for examination:
- A
high school diploma or its equivalent;
- Hold
a valid Maine Barber or Cosmetology License;
- Demonstrate
fifteen hundred (1500) hours of experience as a licensed
barber or cosmetologist within three (3) years proceeding
the date of application. Of the fifteen hundred (1500)
hours, up to five hundred (500) hours may be substituted
at the rate of one hundred (100) hours for each college
credit earned. Evidence of work experience may be submitted
by:
- Copies
of income tax "C" form for self-employment; or
-
W - 2 form for employment.
Educational
requirements - In addition you must have completed one
of the three requirements below:
- Complete
a course of study for the preparation of barber or cosmetology
instructors consisting of at least one thousand (1,000)
hours in not less than six (6) months in a school for
barbering or cosmetology licensed by the Board; or
- Complete
twelve (12) credits from a post secondary school, college,
or university in educational courses related to teaching
the Board has approved. The following topics are acceptable
toward clock hours of post secondary credits:
- History
and philosophy of education;
- Methods
and materials in teaching;
-
Curriculum development;
- Measurement
and evaluation in teaching;
- Business
organization and management; or
- Provide
proof of a valid instructor license in another state
and evidence of at least fourteen (14) clock hours
or 1½ post-secondary credits of continuing education
acquired within the past two (2) years from the date
of application in courses or seminars relating to
teaching.

the above qualifications are met, the following will be
required for licensure:

- Continuing
Education - Once you officially hold an Instructor
license, you will be required to comply with continuing
education requirements in order to renew your license.
You must also maintain a valid barber and/or cosmetology
practice license (whichever applies in your case) at all
times. All persons holding valid barber or cosmetology
instructors licenses are required to complete fourteen
(14) hours of continuing education to be submitted at
the time of license renewal having been completed within
the two- (2) year biennium of that licensing period. In
other words, if your license expires January 31, 2002,
your continuing education must have been completed between
the dates of February 1, 2000 and January 31, 2002. To
qualify for purposes of licensure renewal, continuing
education hours must contribute to the goal of maintaining
or increasing the knowledge, skill and competence of instructors.

Description
Schools
of cosmetology and barbering means any person, partnership, association
or corporation located either within or outside the State must
obtain a license as specified under section 14246 from the board
before operating or maintaining any school of barbering or school
of cosmetology within the State or before collecting any tuition,
fee or other charge for operating or maintaining such a school
within the State.

local building code standards. Such documentation should
include copies of current permits or certificates indicating
compliance.

floor plan and description of the facility which will
house the school and its program. Attention should be
given to identifying the use made of the indicated areas,
and the dimensions and square footage of each.
- Tuition,
Fees, Other Charges: Cite catalog/brochure page(s).
- Admission
Requirements: Cite catalog/brochure page(s).
- Instructional
Staff: For each staff member, please indicate name, background
experience and teaching assignment. Include the license
number, license expiration date, and date of employment
for each.
- Record
Keeping and Reporting Procedures: Submit copies of all
forms.
- Academic
Progress Standards: Enclose copies or cites catalog/brochure
page(s).
- Graduation
Requirements: Enclose copies or cites catalog/brochure
page(s).
- Five
copies of the school's current catalog/brochure must be
submitted.
- Evidence
shall be submitted to indicate that the school has a valid
surety bond as required by 32 MRSA, Subchapter IV, §14246(1).
The appropriate form for completion is enclosed.
- Evidence
shall be submitted to show that all licenses and/or permits
issued by local and state agencies indicating compliance
with fire safety and local or municipal building codes
are current and valid.
- A
copy of the most recently financial statement as required

Each
submission for a license renewal must include the school's
most recent financial audit conducted by a certified public
accountant not affiliated with the school. When a school
does not participate in federal or state financial aid programs,
internally prepared financial statements signed by the applicant
are acceptable. Every renewal application must include a
bond in the required amount. The school must certify that:
- The
school has included information in all school brochures
and handbooks provided to students, and has posted information
in a location in the school frequented by students advising
students of their rights to receive refunds and where
to direct any complaints the students have concerning
their education; and
- The
school is in compliance with all applicable federal and
state laws and regulations. Renewal applications are mailed
approximately 30 days prior to the license expiration
date. It is the licensee's responsibility to keep the
Board informed of the current license address and/or to
see that the license is renewed absent the renewal application.

structure, building or part of a building where any activity licensed
under this chapter is practiced.

information:

Fee of $100.00. (This fee covers a $75.00 application
fee and $25.00 initial license fee.) Checks should be
made payable to the Treasurer, State of Maine.
If paying by credit card, please submit the authorization
form with your application.
- Directions
to your establishment. Make directions as clear as possible
noting any identifying signs landmarks or structures that
will assist in locating your establishments.
- Floor
plan of your establishment. Mark entrances, exits, purpose
of each room or area, and location of the required public
rest room. Reminder: all establishments must have a utility
sink or shampoo bowl in addition to the sink that is in
the restroom.

Electrical Approval. If any new or additional electrical
installation is required, a licensed electrician must
complete the installation. Once the electrical installation
is complete, the master electrician must obtain a signed
approval from your local code enforcement officer or,
if your town does not have one, from a state electrical
inspector. Establishments that apply for a change of ownership
are not required to submit documentation of compliance
if the existing establishment does not have any electrical
work or renovations done and the initial inspection was
done within 5 years from the change of ownership. Questions
about electrical installations should be directed to your
electrical contractor.
- Plumbing
Approval. A plumbing permit must be obtained from your
city or town office. Questions regarding plumbing installations
should be directed to the local plumbing inspector in
your city or town. Upon completion of the plumbing installation,
your local plumbing inspector must inspect and approve
the plumbing. Once approved, the plumbing inspector will
authorize the installation to be in compliance with the
Maine Plumbing Code and must sign the plumbing permit
where indicated. You must have this signed document available
at the time that the barbering and cosmetology inspectors
conduct the inspection of your shop.
- If
you have a private water supply, it must be tested prior
to the licensure of your establishment. The water report
must be presented to the inspector at the time of inspection.
Private sewage systems shall meet the standards set by
the Department of Human Services.
Please
pay particular attention to Chapter 3 of the Board rules.
Chapter 3 will provide you with substantial information
in setting up your business, sanitary and safety compliance
requirements. Inspections conducted by the inspectors track
the provisions of Chapter 3.
Once
our office has received your completed application, an inspection
will be scheduled and you will be notified by telephone.
We request at least two weeks advance notice to schedule
inspections. Every effort is made to schedule inspections
as quickly as possible. Inspections will not be conducted
or passed unless the premise is complete and ready for operation.
This means that your physical construction is completed,
equipment is in place and operational, and you have adequate
tools, implements and supplies on hand. An establishment
that may require a special inspection, such as a follow
up inspection due to the establishment not being complete
or all the appropriate approvals not available at the time
of the agreed scheduled inspection, may be assessed a separate
inspection fee.
This
agency can not be held responsible for advanced bookings
of clientele and/or advertisements placed. Your establishment
can not open for business until it has been inspected and
approved for licensure by this office.

receipt of the completed application, an inspector will
determine if an inspection is required. If an inspection
is required, you will be notified by telephone as to the
date of that inspection. If the booth does not need an inspection,
your license will be issued and sent to you.
You
may begin working as a booth renter only when your application
for a booth license is approved. Your license will arrive
in approximately two weeks. Your booth license, as well
as your license to practice, must be conspicuously displayed.

Our Purpose
The State
Board of Barbering and Cosmetology was established to protect
the public through the regulation of the practice of barbering
and cosmetology in the State of Maine.
The primary
responsibility of the Board is to regulate the practice of cosmetology,
barbering, aesthetics and manicuring by qualifying applicants
for licensure. The Board investigates allegations of noncompliance
and acts on these complaints by imposing discipline when necessary.
The Board creates safety and sanitation rules and enforces these
rules through regular inspections of licensed establishments and
consumer complaints. In addition, the Board licenses and regulates
schools that offer and provide professional practice courses in
the field of cosmetology and barbering.
